A Naples mother who had her 13-year-old daughter’s head shaved and private area pierced to prevent her from continuing to have sex was acquitted of child abuse charges Thursday.

A five-man, one-woman Collier Circuit Court jury deliberated roughly three hours before deciding the 39-year-old mother was not guilty of aggravated child abuse or child abuse, finding her actions didn’t involve punishment, malicious intent or cause permanent damage or disfigurement.


This also serves as a very compelling argument for people with frontal lobes actually reporting for jury duty.

People with frontal lobes tend not to make it through voir dire.

Also, it sounds like the sort of case where the jury had to hold its nose and vote with the letter of the law. In other words, the laws themselves were probably sufficiently out of date that the jury wasn't allowed to convict the mom just for being a horrible person, so long as she didn't trip any of the specific things mentioned in statue.

No one I know who has been called for jury duty has ever been chosen for a jury...

With the jury, it sounds like what you said - but also that they sympathized with the mom - something I can see from what the article describes - but that doesn't make her actions magically right...

Personally, I'd not charge the mom with any crime - but she shouldn't be parenting any of her children if that's the kind of judgement she shows...
But, of course, the jury doesn't get to do things like that - they can only pass judgement on what they're told...

I actually have served, it was a DUI case, and ended in a hung jury. For some reason, they didn't introduce the police car's dashboard cam tape as evidence, and there were a few "won't take a cop's word over a biased witness's without physical evidence" people on the jury that couldn't be convinced...but also a few of us who knew there was no way he wasn't impaired even if he hadn't drunk much. We really felt the prosecution dropped the ball, although the defense attorney was comically inept as well.

Unfortunately, piercings are not illegal with parental consent [not that this will necessarily stop said daughter from sex]...and are often done consentingly.

And shaving of the head? A hat, a wig, and hotsytotsy teenager is good to go again.

I will say the mother was a little archaic and a lot stupid in her methods, but no, it probably doesn't qualify as abuse.

You see, here's the thing: I don't think you can make the case that the piercing was (a) consensual (b) anything but punitive. In this case, it's a de facto form of genital mutilation, and the piercer Meredith (apparently the first reference of "Meredith" got edited out in the story, it's a little confusing here) rightfully got busted for it but cut a deal to testify against Mommy Dearest; in these circumstances, you could make a pretty convincing assault case.

The cutting of the rose is an abomination and a human rights violation wherever it occurs, and I'm sickened by the fact that it seems to have migrated to American shores now.

But the article you linked..it said the girl's brother convinced her to accept the piercing to gain the trust from their mother.

That is enough to make a case for consent right there.

But honestly, the mother needs to not get her kids back if she did do this to get even with her daughter for sleeping with her man and then NOT GETTING RID OF THE MAN.

And yes, they've got a very interesting view of family values. These kids are best kept as far away from this woman as possible. Someone needs to be shot to Mars.
